Terms of Service
Last updated: October 31, 2026
These Terms of Service ("Terms") govern your access to and use of the Ideal Vibe mobile application ("App") and website (collectively, the "Services") provided by the operator of Ideal Vibe ("the operator," "we," "us," or "our"). Ideal Vibe is a personal project operated by a private individual: Rumen Radev, Varna, Bulgaria. Please read these Terms together with our End User License Agreement ("EULA") and our Privacy Policy. The Privacy Policy explains how we process personal data; it is not a term of this agreement. Section 1 explains how you agree to these Terms. If you do not agree to them, do not use the Services.
Notice for residents of the United States: Section 17 of these Terms and Section 12 of the EULA provide for binding individual arbitration and for a waiver of class actions and jury trials. You can opt out within 30 days. Please read them.
1. Acceptance of Terms
You agree to these Terms when you create an account or use the Services. If you sign up with an email address and a password, the App asks you to tick a box to agree to these Terms. Before you can use the App, it also asks every user to accept the EULA, which includes these Terms, and to confirm that they have read the Privacy Policy. If you do not agree to these Terms, do not create an account and do not use the Services.
If you use the website without an account, these Terms govern your use of the website. Using the website alone does not mean that you have agreed to the purchase terms in Section 5 or to the arbitration agreement that Section 17 refers to.
You can read, save or print the current version of these Terms on this page at any time. On request to legal@idealvibe.app we send you a copy of the current version or of an earlier version.
In these Terms, a "consumer" is an individual who uses the Services for purposes outside a trade, business or profession.
We may update these Terms from time to time (see Section 15).
2. Eligibility and Age Requirements
You must be at least 18 years old, or the age of majority where you live if that is higher (20 in Thailand), to use the Services. When you first use the App, it asks for your year of birth. The App may also ask Google Play or Apple whether your store account belongs to an adult. If the store says that the account belongs to a person under 18, you cannot continue, whatever year of birth you entered. If the year of birth you enter shows that you are under 18 (under 20 in Thailand), you cannot continue. You can then sign out or delete your account, or write to privacy@idealvibe.app and we will delete it.
Some venues centred on alcohol, tobacco or gambling appear in the App only from the local legal age for them (for example 21 in the United States). The App hides these venues until you have given your year of birth, and for as long as you are below that age.
If we learn that a user does not meet the age requirement, we may close the account and delete its data. The Creator Bounty Programme has its own eligibility rules; see the Official Bounty Rules.
3. License to Use the App
Subject to these Terms and the EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use on devices you own or control. Detailed software licensing terms are set out in the EULA.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
- Interfere with, disrupt, or place undue load on the Services or related infrastructure.
- Misrepresent your age or provide false information to bypass age or consent requirements.
- Resell, sublicense, or commercially exploit the Services without our written permission.
5. Subscriptions, Purchases, and Billing
Ideal Vibe offers optional paid features under the name Ideal Vibe PRO ("PRO"). PRO is offered as a Monthly plan and a Yearly plan. The plan screen in the App shows what PRO adds. The price, the currency and any taxes are those the store shows before you buy. Purchases made on mobile are processed by the Apple App Store or Google Play and are subject to their terms. Our Refund Policy forms part of these Terms.
5.1 Renewal, Free Trials and Cancellation
Monthly and Yearly plans renew automatically for the same period, at the price that then applies, until you cancel. Each renewal is charged to your store account. To avoid the next charge, cancel before the end of the current period; on the App Store, cancel at least 24 hours before it ends. Where a free trial is offered, it becomes a paid subscription at the price shown when you start it, unless you cancel before the trial ends.
You can manage or cancel subscriptions in your App Store or Google Play account settings. Cancelling stops the next renewal, and you keep PRO until the end of the period you have already paid for. Deleting your Ideal Vibe account does not cancel a store subscription; cancel it in the store.
5.2 Lifetime
Lifetime is no longer on sale. If you bought it, this section keeps applying to your purchase, and nothing here ends or shortens it.
"Lifetime" is a one-time payment for a personal, non-transferable licence to use the PRO features on your account. It does not mean your own lifetime, it does not give you ownership of PRO or of the App, and it does not renew. PRO features may change as Section 15.1 describes.
Lifetime PRO lasts for as long as we offer PRO in the App. If we stop offering PRO or the App within 24 months of your purchase, we refund the part of the price that matches the unused remainder of those 24 months. After 24 months we may stop offering PRO or the App with at least 30 days' notice and without a refund, unless the law of your country gives you more.
Wherever another section of these Terms gives a pro-rata refund, for a Lifetime purchase it is the part of the price that matches the unused remainder of the 24 months from your purchase. After those 24 months no pro-rata amount remains, unless the law of your country gives you more.
A Lifetime purchase is refunded in full if you ask within 14 days of the purchase, wherever you live. After those 14 days it is final and is not refunded, except where the law of your country requires a refund or these Terms give one (see this Section 5.2 and Sections 14 and 15.1). For consumers in the European Economic Area and the United Kingdom, the 14-day refund is also the right of withdrawal that the law gives them (Section 5.5). This does not affect your statutory rights in respect of services that are faulty or not as described.
5.3 Price Changes
The price of a running plan changes only from a later renewal, never during a period you have already paid for. The store tells you about a price change in advance and, where the law requires it, so do we. Where the store or the law requires your consent to the new price, your subscription ends at the end of the current period unless you accept the new price. You can always cancel before the new price applies.
5.4 Refunds
How you ask for a refund depends on the store. Apple alone decides on and processes refunds of App Store purchases, so ask Apple. For a Google Play purchase, ask Google within 48 hours of the purchase. After those 48 hours, write to legal@idealvibe.app; where these Terms, the Refund Policy or the law give you a refund, we refund you through Google Play.
If these Terms, the Refund Policy or the law give you a refund and the store refuses it, write to legal@idealvibe.app and we pay it. Nothing in these Terms limits a right of refund, cancellation or withdrawal that the law of your country gives you and that cannot be waived. See our Refund Policy for details.
5.5 Right of Withdrawal in the European Economic Area and the United Kingdom
If you are a consumer in the European Economic Area or the United Kingdom, you have 14 days to withdraw from a purchase of PRO without giving a reason. The 14 days run from the day of the purchase. If your purchase starts with a free trial, the 14 days normally run from the day the trial starts, provided the price charged after the trial was shown to you before you started it. A renewal does not normally start a new 14-day period. Where the law of your country gives you a longer or a new period, that applies. PRO is a digital service that starts as soon as you buy, and you keep the right to withdraw for the full 14 days. If you withdraw within the 14 days, we refund the full price you paid (Monthly, Yearly or Lifetime), with no deduction for the time you had PRO.
To withdraw, send a clear statement to legal@idealvibe.app before the 14 days end, with the email address of your account, the date of the purchase and the order number from your receipt. You can use the wording below, but you do not have to. We confirm that we received your statement, and the refund is made within 14 days of the day we receive it, through the store or by us. You can also withdraw through the store, as Section 4 of the Refund Policy describes.
To Rumen Radev, Varna, Bulgaria, legal@idealvibe.app: I withdraw from my contract for Ideal Vibe PRO (Monthly / Yearly / Lifetime). Ordered on: (date). Order number: (from your receipt). Name: (your name). Account email: (your email address). Date: (date).
6. Advertising
The free tier of the Services is supported by advertising, including ads served by Google AdMob. Whether the ads you see are personalized depends on your country and your choices:
- In most countries, ads are personalized only after you agree to personalized ads.
- In the United States, personalized ads are on from the start, and you can switch them off at any time.
- Where ads are shown but are not personalized, they are non-personalized ads.
You can review and change your ad choices at any time in the App under Profile > Privacy & legal > Privacy Controls. Section 11 of our Privacy Policy explains how advertising uses your data. Section 22 says where the App handles ads differently in a country.
6.1 Rewarded Ads and Pro Passes
Where the feature is switched on, the App may offer a Pro Pass: temporary access to PRO in return for watching ads. It is optional. The offer in the App says what you need to do and what you receive. Normally your first Pass starts automatically after your first completed ad. A later Pass starts when you claim it and replaces any Pass that is still running; Passes do not add up. A Pass ends automatically when its time runs out.
Limits apply, including a maximum number of ads per day, a waiting time between ads, and a daily limit on the total number of Passes for all users. When that total is reached, an ad you complete may not earn a Pass that day. A Pass is granted by Ideal Vibe, not by Google. It has no cash value, cannot be transferred or refunded, and is not a purchase. We may withhold or cancel a Pass if we reasonably suspect automated means, multiple accounts or other abuse. We may change or end the Pro Pass feature. It may not be available in every country.
On the free tier, the App may also ask you to watch an ad before it opens Google Maps.
7. Weather and Activity Information — No Reliance for Safety
Activity suggestions are produced by fixed rules from third-party weather and place data. They are not advice, and they do not take account of your health, skill, equipment or local hazards. The App is not a warning service. You decide whether an activity is safe for you.
Weather data, forecasts, and activity recommendations are provided for general informational purposes only and may be inaccurate, incomplete, or delayed. They are not intended for emergency, navigational, or life-safety decisions. Always verify conditions with official sources before undertaking any activity. You are solely responsible for your safety and decisions.
Read this Section 7 together with Section 4 of the EULA, which sets out the safety notice and your safety obligations in more detail. Section 12 says which liability these Terms never exclude or limit.
8. Intellectual Property
The Services, including all content, trademarks, logos, and software, are owned by us, our licensors or the third parties that provide them, and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
9. Third-Party Services
The Services rely on third-party providers (e.g., weather data providers, mapping services, analytics, advertising, and payment processors). Your use of those features may be subject to the third party's terms, and we are not responsible for third-party services or content.
The Services show data from third parties, including weather data, map and place data and photographs. That data remains the property of its providers. It may be wrong, incomplete or unavailable. We do not own it and do not promise that it is accurate or available.
10. User Content
Where the Services allow you to submit photographs, video, text, or other material ("User Content"), you retain ownership of your User Content. Photos and videos that you make or edit with Share Studio are processed on your device and are not sent to us; we acquire no rights in them. Entries to the Creator Bounty Programme are governed by the Official Bounty Rules; Section 9 of those Rules sets out the rights in a winning entry.
For any other User Content that you send to us, you grant us a worldwide, non-exclusive, royalty-free licence, which we may exercise through our service providers, limited to hosting, storing, reviewing and displaying it as needed to run the feature you used. That licence ends when you delete the content or your account, except for copies that we must keep by law. We ask for your separate consent before we use such content to promote the Services.
You represent that you own or have all necessary rights to your User Content, that it does not infringe any third-party right, and that, for every identifiable person and any private property shown, you hold the permission or release needed for the uses these Terms describe.
You must not submit content that is unlawful, defamatory, obscene, hateful, harassing, or that depicts unsafe or illegal activity. We may remove User Content that breaches these Terms or the law, and may suspend an account as Section 14 describes. We tell you the reason and how to contest the decision.
10.1 Notice and Takedown
When you submit a bounty entry, we store the links and the text you give us (for example the links to your video and photos, your name, your email address, the shooting location and your payout method), not the photos or videos themselves. The material you link to is hosted by the service you chose. Section 9 of the Official Bounty Rules says what happens to a winning entry.
If you believe content on the Services infringes your rights or is otherwise unlawful, contact legal@idealvibe.app. Please give a description of the material and of the legal ground of your complaint, its exact location, your contact details, and a statement that you are acting in good faith. For a copyright claim under United States law, please also include a statement that you are the owner or are authorised to act for the owner, and your signature.
A person reads every notice and decides on it; we do not use automated tools for these decisions. We confirm that we received your notice and decide without undue delay. We send our decision, with the reasons and the ways to contest it, to you and to the user concerned. You can contest a decision by replying to the same address or by going to court.
For a copyright claim under United States law, the user concerned may send a counter-notice to the same address, and we handle it as the law that applies requires. We end the accounts of repeat infringers in appropriate circumstances.
11. Disclaimers
Ideal Vibe is a personal activity planner. It suggests outdoor and indoor activities from weather data, place information and rule-based scoring. These suggestions depend on third-party data and may be wrong, incomplete or late.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
This section does not exclude or limit any guarantee, warranty or remedy that the law of your country makes mandatory. Section 22 has rules for specific countries.
12. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services shall not exceed the greater of (a) $100 USD, or its equivalent in your currency, and (b) the amounts you paid for the Services, including through an app store, in the 12 months preceding the event giving rise to the claim or, for a Lifetime purchase, the price you paid for it.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, under product liability law that cannot be excluded by contract, for a violation of law where the law does not allow that liability to be excluded or limited, for any right or remedy that you have by law as a consumer and that cannot be excluded or limited (including a refund, a price reduction or the remedies for a digital service that does not conform to the contract), or for any other liability that cannot lawfully be excluded or limited. Where mandatory law in your country of residence does not permit the exclusions or limitations set out above, they apply only to the maximum extent permitted by that law, and the remainder of this section continues in force. Section 22 has rules for specific countries.
13. Indemnification
If you are not a consumer, you agree to indemnify and hold harmless the operator and any affiliates, officers, and employees of the operator from third-party claims, and from the resulting losses, damages, liabilities, and expenses (including reasonable legal fees), arising from your unlawful use of the Services, your breach of Section 4, or your User Content infringing someone's rights.
If you are a consumer, you do not give an indemnity. You remain liable under the law that applies to you for damage that you cause us through your fault.
14. Termination
We may suspend or end your access to the Services only for a serious or repeated breach of these Terms, unlawful use, fraud or abuse, a security risk, or where the law requires it. Unless the breach is serious or the matter is urgent, we first warn you and give you the chance to put things right. We tell you the reason and how to contest the decision: reply to our message or write to legal@idealvibe.app.
If we end a paid plan, we refund the unused part of the period you paid for pro rata, also when the reason is your breach. For a Lifetime purchase, Section 5.2 says how that part is worked out. Section 15.1 applies if we stop offering PRO or the App. Your statutory rights are not affected in any case.
You may stop using the Services and delete your account at any time from within the App. Deleting your account does not cancel a store subscription; cancel it in your App Store or Google Play account. A purchase made on Google Play is tied to your Ideal Vibe account and cannot be moved to a new account, so PRO from that purchase, including Lifetime, ends when the account is deleted.
Section 19.3 lists the sections that continue to apply after these Terms end.
15. Changes to These Terms
We may change these Terms for these reasons: a change in the law or in the requirements of an authority or an app store; security; new or changed features; a change of service providers; or to correct errors and make the text clearer. We post the current version on this page with the date of its last update.
We announce a material change by email or in the App at least 30 days before it applies. If you do not agree, you can stop using the Services and end the contract without cost. If you tell us in writing within those 30 days that you do not agree, you may end the contract without cost or, where the change is not required by law or by an authority, continue under the earlier terms. A change required by law can apply sooner.
A material change is one that reduces your rights or adds to your obligations, for example a change to billing terms, liability or dispute resolution. A change to the price of a plan follows Section 5.3, not this section. Other changes apply when we post the new version. To tell us in writing, write to legal@idealvibe.app. A change does not apply to a dispute that arose before it. Section 12 of the EULA says how a change to the arbitration agreement for users in the United States can be rejected.
15.1 Changes to the Services
We may change, suspend or discontinue the Services or a feature for these reasons: legal or app store requirements, security, a change to or the loss of a third-party data source, technical development, preventing abuse, or improving the Services. A change costs you nothing, and we tell you about it clearly.
Where a change materially reduces what a paid plan gives you, we tell you at least 30 days in advance by email or in the App. You may then end your paid plan within 30 days of our notice or of the change, whichever is later, and we refund the unused part of the period you paid for pro rata. If we stop offering PRO or the App, we give the same notice and the same refund. For a Lifetime purchase the same notice applies, and Section 5.2 says how the refund is worked out.
16. Governing Law
These Terms are governed by the laws of Bulgaria, without regard to conflict-of-laws principles. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of that country. Nothing in this section limits any right you have to bring a complaint before a competent authority or to use an out-of-court dispute resolution scheme.
If you are a resident of the United States and have not opted out of arbitration, Section 17 and Section 12 of the EULA decide how and where disputes are resolved, and the Federal Arbitration Act governs that arbitration agreement.
To make a complaint about these Terms, a purchase or the Services, write to legal@idealvibe.app. We acknowledge your complaint within 2 business days and answer it within 14 days. For a request or complaint about your personal data, the times in Sections 9 and 15 of our Privacy Policy apply. If you are a consumer in the European Economic Area, you may also contact the consumer protection authority of your country or your European Consumer Centre.
17. Dispute Resolution — United States Users Only
This section applies only if you are a resident of the United States. It does not apply to consumers resident in the European Economic Area, the United Kingdom, or any other jurisdiction where pre-dispute binding arbitration of consumer claims is unenforceable.
If you are a resident of the United States (including its territories), you and the operator agree to resolve disputes by binding individual arbitration and not in court. You and the operator each give up the right to a jury trial and the right to take part in a class action. This does not apply if you opt out. You can opt out within 30 days of first accepting the EULA, by email to legal@idealvibe.app.
The arbitration agreement is set out once, in full, in Section 12 of the End User License Agreement. You and the operator agree that it applies to any dispute, claim, or controversy arising out of or relating to these Terms or the Services. This Section 17 adds no arbitration terms of its own. The exceptions, such as small-claims court, the way to opt out and the rule for changes are those of Section 12 of the EULA, and one opt-out covers these Terms and the EULA.
Ticking the arbitration box in the App has no effect if you are not a resident of the United States.
18. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, epidemic, labour disputes, governmental action, network or power failure, or the failure or interruption of third-party services on which the Services depend, including weather data providers.
This section excuses a delay or failure only for as long as the event lasts. It does not affect a consumer's statutory remedies or the right to a refund for paid services that were not provided.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19.1 Assignment
You may not assign or transfer these Terms, your account or any rights under them without our prior written consent. We may transfer these Terms in whole or in part to an affiliate or in connection with a merger, acquisition, reorganisation, or sale of assets, on notice to you. If you are a consumer, a transfer does not reduce your rights under these Terms, and if you do not agree to it you may end the contract without cost.
19.2 No Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other, and no single or partial exercise of a right precludes any further exercise of it.
19.3 Survival
Any refund owed under these Terms remains owed after these Terms end. These sections also continue to apply after these Terms end: Section 10 for content that we are entitled to keep, and Sections 11, 12, 13, 16, 17, 20 and 22.
20. Entire Agreement
These Terms, together with our End User License Agreement, our Refund Policy and, if you enter the Creator Bounty Programme, the Official Bounty Rules, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements. Our Privacy Policy explains how we process personal data; it is not a term of this agreement. Nothing in this section excludes a statement that the law treats as part of the contract.
If these documents conflict, the Official Bounty Rules govern the Creator Bounty Programme; the End User License Agreement governs the licence to use the App, the restrictions on use, the Apple App Store terms and dispute resolution for users in the United States; the Refund Policy governs refund amounts and how to ask for a refund; and the Terms of Service govern everything else.
These Terms are published in Arabic, Bulgarian, Chinese (Simplified), English, French, German, Japanese, Portuguese, Russian and Spanish. The contract is the language version that was shown to you when you agreed to these Terms. Where the law of your country gives you the right to the contract in an official language of that country and we publish these Terms in that language, you may also rely on that version.
21. Sanctions, Export and Lawful Use
The Services are offered worldwide, wherever the App Store and Google Play offer the App. Some features, including ads, Pro Passes, Nearby Places and purchases, differ from country to country or are not available everywhere. The Services are for personal, non-commercial use by individuals.
You must not use the Services where the law that applies to you, or sanctions or export-control law, forbids it. We may refuse or end service where sanctions or export-control law requires us to.
22. Additional Terms for Specific Countries and Regions
This section adds to the rest of these Terms for users in the countries and regions named below. If a rule here differs from another section, the rule here applies to you. For the legal terms in this section, the country that counts is the country where you live. Sentences that describe how the App behaves in a country apply where the App has detected that country.
22.1 European Economic Area
If you are a consumer in the European Economic Area, the law gives you a legal guarantee that a digital service conforms to the contract. If it does not, you are entitled to have it brought into conformity or, failing that, to a price reduction or to end the contract. Sections 11 and 12 do not limit this guarantee or its remedies. The mandatory consumer law of the country where you live applies in addition to these Terms. Section 5.5 describes your right to withdraw from a purchase, and Section 16 says how to complain.
22.2 Germany and Austria
If you are a consumer in Germany or Austria, this paragraph applies to you in place of Section 12. We are liable without limit for intent and gross negligence, for injury to life, body or health, under mandatory product liability law, and under a guarantee that we have expressly given. For slight negligence we are liable only for the breach of an essential contractual duty, and then only for the foreseeable damage that is typical for this kind of contract. An essential contractual duty is a duty that must be met for the contract to be performed properly and on which you may regularly rely. In all other cases of slight negligence we are not liable.
If you are a consumer in Germany and your Yearly plan has renewed automatically, you can end it at any time after the first term with at most one month's notice, and we refund the prepaid time that you have not used. To do so, write to legal@idealvibe.app, and cancel the subscription in your store account so that it does not renew.
22.3 Bulgaria
If you are a consumer in Bulgaria and your Yearly plan has renewed automatically, you can end it at any time after the first term with at most one month's notice, and we refund the prepaid time that you have not used. To do so, write to legal@idealvibe.app, and cancel the subscription in your store account so that it does not renew.
22.4 United Kingdom
If you are a consumer in the United Kingdom, Sections 11 and 12 do not limit the rights and remedies that the law gives you where a digital service is not of satisfactory quality, not fit for its purpose or not as described. Section 5.5 describes your right to withdraw from a purchase.
22.5 United States
If you are a resident of the United States, Section 17 and Section 12 of the EULA say how disputes are resolved. Where the law of your state does not allow the exclusion of implied warranties or the exclusion or limitation of certain damages, the exclusions and limits in Sections 11 and 12 apply to you only as far as that law allows.
In the United States, personalized ads are on from the start. You can switch them off under Profile > Privacy & legal > Privacy Controls. In the 50 states and the District of Columbia, that screen also shows the switch "Universal opt-out (Do Not Sell or Share)".
22.6 Australia and New Zealand
If you are a consumer in Australia or New Zealand, nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993 gives you and that cannot be excluded. Nothing in these Terms, including Section 5, says that a refund or another remedy is unavailable where those laws give it to you.
22.7 Other Asia-Pacific
In mainland China the App runs in a restricted mode: it shows no ads, does not use analytics or crash reports, and the privacy choices are switched off and cannot be switched on in Privacy Controls. We send the newsletter only if you subscribe to it in the App's notification settings.
22.8 Other countries
In Russia the App runs in a restricted mode: it shows no ads, does not use analytics or crash reports, and the privacy choices are switched off and cannot be switched on in Privacy Controls. We send the newsletter only if you subscribe to it in the App's notification settings.
